A BILL to amend article four, chapter eighteen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, by adding thereto a new section, designated section six-a, relating to higher education; general administration; and authorizing and requiring the construction, maintenance and operation of dormitories for students after their freshman year at West Virginia university.

Be it enacted by the Legislature of West Virginia:
That article four, chapter eighteen-b of the code of West Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section six- a, to read as follows:
ARTICLE 4. GENERAL ADMINISTRATION.

§18B-4-6a. Acquisition, operation and regulation of dormitory housing areas and facilities at West Virginia University; disposition of revenue.

The governing board of West Virginia University is herebyauthorized and required to construct, maintain and operate dormitory housing facilities upon any premises owned or leased by West Virginia University for use by students from their sophomore year, upward. The governing board may charge fees for use of the dormitory housing facilities under their control. All moneys collected for the use of the dormitory housing facilities shall be paid to the credit of West Virginia University into a special fund which is hereby created in the state treasury. The moneys in the fund shall be used first to pay the cost of maintaining and operating the dormitory housing facilities, but any excess not needed for this purpose may be used for the acquisition of property by lease or purchase and the construction thereon of additional dormitory housing facilities. Any money in the fund not needed immediately for the acquisition, construction, maintenance or operation of the dormitory housing facilities may be temporarily invested by the governing board with the state board of investments to the credit of West Virginia University.



NOTE: The purpose of this bill is to require the governing board of West Virginia University to construct, maintain and operate dormitory housing for students in their sophomore year and thereafter.
